1. Who operates the service
The operator of the Tricho.app application (the “app”) is Ing. Jan Beránek, company ID (IČO) 88869709, with its seat at Brozany 194, 533 52 Staré Hradiště, Fyzická osoba zapsaná v živnostenském rejstříku, Magistrát města Pardubic (the “operator”). Contact: [email protected]. We reply within fourteen days at the latest.
The same address is the single point of contact under Regulation (EU) 2022/2065 on digital services — for you, for anyone who wants to report something, and for the authorities. We write in Czech and English.
2. What Tricho.app is
Tricho.app is an app for trichologists and hairdressers: a diary of visits, a client card, a visit statement with a receipt and, optionally, sales recording. It includes Booking (Objednávání) — a public page where your clients pick a free slot — and an optional connection to Google Calendar and Google Tasks. Data is encrypted directly on your device; only the encrypted form, which the operator cannot read, goes to the server (more in the privacy policy).
On the Max plan it also includes Events (Akce) — courses and workshops that participants register for on your public page and pay for in advance — and on the Pro and Max plans deposits for slots in Booking. In all of these you are always the seller. Tricho.app operates the software through which the organiser sells in her own name and for her own account. Details are in Article 11a.
Legally, this is a digital content service under § 2389a et seq. of the Civil Code. This means that you are not buying a thing, but access to a service for the agreed period, and that the operator is responsible for the service corresponding, throughout that period, to what is described here and on the Pricing page.
3. Who these terms apply to
The default regime is the consumer regime. If you acquire Tricho.app as an individual outside your business, you are a consumer and the whole protective regime of the Civil Code and the Consumer Protection Act applies to you. Nothing in these terms takes those rights away from you.
Many trichologists and hairdressers acquire the app for their trade. Even so, the consumer regime applies to you by default. A company ID on an invoice alone does not make you a business customer. A contract that serves partly business and partly personal needs (a so-called dual-purpose contract) is assessed as a consumer contract if the business purpose is not predominant. We are glad to issue an invoice with your company ID for your accounting — it has no effect on your status.
The business regime applies only if you enter the contract evidently and predominantly for the purposes of your business. The only way it differs from the consumer regime is the limitation of compensation for harm in Article 16. Everything else — the price, the fourteen-day refund, the deletion of the account — is the same for you.
4. How the contract is formed
You switch on the Free plan yourself, and that does not conclude any paid contract. You order a paid plan in the app on the Subscription screen: you choose a plan, which shows its total price, and press the button “Pay by card” or “Pay by QR code” under the heading “Pay 299 CZK” (or “Pay 999 CZK”, depending on the plan). The button is labelled this way on purpose — the law (§ 1826a) requires that you can tell from it that the order obliges you to pay. For a card, below the button it also says “Renews automatically every year. Cancel any time.”
The contract is formed by payment. Right after it you receive a confirmation e-mail: a proof of payment (plan, period, amount, variable symbol), a link to the invoice — the tax document is issued by Stripe — and links to these terms and to the privacy policy in the version valid on the day of the order. Save or print it; you can always find the terms at this address too.
5. Plans and prices
- Free — free forever. No time limit, no trial period, no payment card. One device, no sync and no cloud backups; you have the encrypted backup to a file here too.
- Pro — 299 CZK/year. Sync of 2 devices, encrypted cloud backups 12 months back.
- Max — 999 CZK/year. Sync of 5 devices, encrypted cloud backups 5 years back.
Prices are final and we state them including any tax. The current price list is always on the Pricing page; a change of the price list never affects a period that has already been paid. We sell paid plans as annual. A promotional price or a discount code applies only within the scope stated with it (typically the first year); after that the regular price list applies and we remind you before renewal.
What each plan can do — the number of devices, backups, Booking, statements — is described in detail on the Pricing page; it forms part of these terms in the version valid on the day of the order.
How much data fits. A technical ceiling applies to the stored encrypted content in the cloud: Pro 4 GB, Max 16 GB. Free does not sync anything to the cloud, so this ceiling does not concern it. It is not a billing meter but a safeguard against abuse — for an ordinary card file with photographs of the scalp it leaves a large margin. When you approach the ceiling, we will get in touch before anything stops working.
6. Payment, invoices and renewal
You can pay by card (processed by Stripe) or by bank transfer (a QR payment with a variable symbol). The invoice — a tax document with your company ID, if you enter it — is in both cases issued by Stripe.
A card renews. By paying by card you set up an annual subscription, which renews itself at the end of each period at the price valid for the new period until you cancel it. You can cancel it at any time in the app with the Manage subscription button, which takes you to the Stripe customer portal; the cancellation takes effect at the end of the period already paid, which you do not lose. We will let you know of a price change at least 30 days in advance, and until then you can cancel the renewal.
A transfer does not renew. You pay by bank transfer once, for one year. Nothing is charged by itself and nothing is extended by itself — the period simply runs out. You pay for the next period the same way again.
Seven days before the end of the period we remind you what is going to happen — by e-mail and by a notice in the app. For a card, the message says that the subscription will renew automatically, for how much and when, and how to cancel the renewal until then. For a transfer, it says that the period is ending and that you have to pay for the next one yourself. One announcement, two routes, so that it does not slip past you even if you overlook the e-mail.
After the paid period expires, a seven-day grace period runs during which sync still works. After that the account returns to Free.
7. Withdrawal from the contract within 14 days
Within 14 days of payment you can withdraw without giving a reason, and we will refund the full amount. We do not reduce it by the days you used the service, and we do not ask why. This applies to consumers and to business customers alike — for business customers it is a contractual promise beyond the law, but it applies equally.
Before starting sync, we do not ask you to waive the fourteen-day period, and we do not rely on the exception under § 1837(l). A consumer's statutory right of withdrawal therefore remains fully intact.
How to withdraw — most easily with a button. In the app, in Settings → Plan, for fourteen days from payment there is a “Withdraw from the contract” button. One tap, no form, no explaining. A sentence to [email protected] is just as good — both have exactly the same effect, and e-mail works even when you cannot get into the app.
The operator refunds the money manually, by the same route it came (by card back to the card, by transfer back to the account the payment came from), within 14 days of receiving the withdrawal. The button records the withdrawal and ends the subscription immediately; the transfer of the money takes as long as the bank takes. From 1 January 2027 the law requires such a button (§ 1830a of the Civil Code as amended by Act No. 159/2026 Coll.) — we have it earlier than we have to.
8. What happens when the subscription ends
The app and all of your data stay with you. Local data on the device keeps working — including the encrypted backup to a file, which Free has too. Sync between devices stops working, and no further device beyond the Free plan limit can be added.
Cloud backups that have already been made run for the period given by the plan in which they were made (Pro 12 months, Max 5 years) and then expire by themselves. The encrypted data on the server stays stored until you delete the account yourself — deleting the account also removes the backups. We cannot read any of it; we do not have the key.
9. Your keys, your responsibility
Tricho.app is designed so that the operator has no access to your data — and therefore cannot recover it either. If you lose access to all of your devices and at the same time lose the recovery key and the encrypted backups, the data is irretrievably gone. There is no “forgotten password” — that is not a flaw but a feature, thanks to which nobody else can get to the data. Keep the recovery key safe and make backups.
10. Services you connect yourself
Google Calendar and Google Tasks. The connection is voluntary and you can end it at any time. Your events and tasks stay with Google and are governed by its terms; Tricho.app only displays them and, at your instruction, creates, changes or deletes them. The operator is not responsible for what Google does with its services — outages, interface changes, revoked access. When Google stops responding, the diary keeps showing your appointments, only without the events from Google, and Booking would rather offer nothing than offer a time when you already have something else. Mirroring appointments “with the client” is switched on only by your decision as the controller of the clients' data (more in the privacy policy).
Receipts and sales recording. The app helps you issue a receipt and, if you turn it on, submit a sale to the Financial Administration's recording system. It is a tool, not tax advice: you are responsible for the correctness of your receipts, your tax regime and for meeting the recording obligation. The operator is responsible for the app doing what it promises here and in the help — that is, that it compiles the message according to the Financial Administration's specification, sends it, and warns you when sending failed. It is not responsible for an outage of the Financial Administration's system.
11. Booking, events and your public page
When you turn on Booking, we publish at your address a page with what you write into the profile (name, a short note, services) and with free slots. When you publish an event, an event page is added with what you fill in for the event (title, description, place, dates, prices, terms). You are responsible for the content of the profile and of event pages. It must not be unlawful, must not contain other people's personal data without their permission or misleading claims about curative effects, and must not infringe the rights of others (trademarks, copyright, likeness).
Reporting unlawful content. Anyone may report content of the public page or of an event page that they consider unlawful to [email protected]. The message should include the address of the page, what exactly is unlawful and why in their view, their name and e-mail (unless it concerns a suspected criminal offence against a child) and a statement that they are writing in good faith. We assess the report without undue delay, manually, and tell the reporter how we decided.
What we may do. If the content is unlawful or contrary to this article, we may hide it or suspend the entire public page or event page. Your diary, cards, received requests and registrations are not affected. We will always write to you right away about what we did, why, on what basis (a report, our own finding) and how you can defend yourself: by replying to our e-mail, which the operator will reassess personally, and further before a court or — if you are a consumer — before the Czech Trade Inspection Authority. We do not use automated moderation.
11a. Events, deposits and payments
Tricho.app operates the software through which the organiser sells in her own name and for her own account. You are always the seller: you conclude the contract with an event participant or with a client who pays a deposit, under your own terms and at your own responsibility, and you are also the controller of their data (the operator is your processor under the processing agreement). For now, events are only for businesses; when you publish an event you confirm that you organise it as a business. The template terms, default deadlines and safeguards are a tool we give you — you are responsible for the wording of your terms, for keeping them and for your taxes.
The money goes straight to you. By transfer to your bank account, by card to your own Stripe account that you connect yourself (you conclude the contract with Stripe). Tricho.app collects nothing from the payments of participants and clients — no commission and no payment fee — and never holds the money.
Tricho.app does not refund money; you make refunds yourself in your Stripe or your bank. When something has to be refunded (a cancellation, a cancelled event, a payment that cannot be accepted), the app prepares a refund task for you with a date. You confirm a card refund in the app and it is made on your Stripe account only on your instruction, or you make it directly in Stripe; a refund by transfer you send from your bank. The server refunds nothing by itself. You keep track of the statutory deadlines: if a client withdraws as a consumer from a contract with a deposit, you must return the money within 14 days of the withdrawal (§ 1832 of the Civil Code); for events the deadlines of your event terms apply. The operator is not responsible for refunding money to participants or clients.
11b. When you sell through Tricho.app (the P2B Regulation)
For Booking and events we also comply with Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services:
- When we may restrict or suspend a page. Only for the reasons in Article 11 (unlawful content or content contrary to that article), for abuse of the service under Article 17, and when the law or an authority requires it. We always give you the reasons for a restriction or suspension right away — what, why and on what basis — and you can object by replying to our e-mail; the operator reassesses it personally.
- Termination of the whole service is announced to you with reasons at least 30 days in advance, unless the law requires the termination or it is a repeated breach of these terms; even then we send you the reasons at the latest with the termination.
- Changes to the terms are announced at least 30 days in advance (Article 19; the Regulation asks for at least 15 days) and never retroactively.
- No ranking or preferential treatment. Tricho.app has no directory or search of organisers and does not rank pages; we do not treat anyone differently for payment.
- Your content (profile, event description, terms) remains yours. You only permit the operator to display it on your page until you delete it or switch the page off.
- Who has access to which data. Only you, in your app, have access to the data of participants and clients (names, contacts, billing data, notes); neither other organisers nor the operator do. What the server sees in readable form — the state of registrations, deadlines, counts, e-mails encrypted with the server's key — is listed in Annex B of the processing agreement. The operator does not use these data for itself, does not sell them, does not link them between organisers and passes them only to the sub-processors in Annex C.
- After termination you take your data with you under Article 12; the registration data held by the server are erased under the periods of the processing agreement.
12. Your data and moving elsewhere
The data is yours and you can take it with you at any time, in every plan and without a fee:
- Readable export (Settings → Readable export): all the data from your vault — client cards, visits, appointments, receipts, the price list and more — in JSON format, and photographs as files — for moving to another service or to your own archive.
- Encrypted backup to a file: the same in a form that you can restore in Tricho.app on another device.
- Account and subscription data that are not in the vault we will send you by e-mail on request.
Only the server's operational and security records (described in the privacy policy) are not part of the export. You can start moving elsewhere at any time, without a notice period and without a fee for moving or exporting. You cancel a paid plan under Article 7 or by not renewing it; the data on the server stays accessible until you delete the account yourself, and the export works in Free too. At your request we will help you with the move. Deleting the account removes the data from the server; where deletion does not reach and for how long (server backups at most two years, encrypted) is described in the privacy policy.
Where the service runs. The sync server and its backups are in the European Union: Frankfurt nad Mohanem, Německo (Oracle Cloud, region eu-frankfurt-1). The website and the app are delivered by Cloudflare (a US company) from its worldwide network; the app files travel through it, not your encrypted data. The contents of the vault are encrypted with a key that only you have — even a request from a foreign state for the disclosure of data would obtain nothing readable from our server.
13. How the app may change
We continuously improve the app and fix bugs in it. Updates are downloaded like an ordinary web app, but they are never installed silently: when a new version is ready, the app shows you a bar with a question and waits for you to confirm. Until then the old one keeps running. Work in progress does not disappear because of it.
Beyond fixes and minor improvements, we may change the app where it is necessary because of the technical environment or security (§ 2389q). We do not make such a change at your expense. If a change would substantially worsen what you use, we will let you know at least 30 days in advance and you may terminate the contract free of charge within 30 days of the notice (or of the change being made, if that is later). In that case we refund a proportionate amount for the unused prepaid period.
14. When the service does not work as it should
The operator is responsible for the service being free of defects throughout the subscription. Report a defect to [email protected] — ideally with a description of what happened and on which device. First we try to remedy it within a reasonable time and free of charge. If that fails, or the defect appears again, you can ask for a discount and, for a substantial defect, withdraw from the contract and get your money back. You exercise your rights from defective performance under § 2389a et seq. of the Civil Code; this paragraph only summarises them, it does not narrow them.
15. Availability
The app is built to work offline: without a connection you keep writing, and a server outage does not cut you off from your data. We strive for the highest possible availability of sync, but we do not guarantee uninterrupted operation. We announce planned downtime in advance in the app.
16. Compensation for harm
If you are a consumer: the operator's liability is governed by law and we do not limit it in any way here. A provision that curtailed your statutory rights would be invalid anyway — so we would rather not have one here.
If you are a business customer and you concluded the contract predominantly for the purposes of your business (see Article 3): compensation for harm is limited to the amount you paid for the subscription in the last 12 months. The limitation does not apply to harm caused intentionally or by gross negligence, to harm to the natural rights of a person, and wherever the law does not permit a limitation.
17. Termination and deletion of the account
You can delete the account at any time directly in the app (Settings → Delete account). Deleting the account removes from the server your encrypted data, the cloud backups that have already been made, and the records of your devices. Export your local data to a file beforehand. You delete a single client permanently directly in her card — where such deletion does not reach is described in the privacy policy.
The operator may terminate an account that abuses the service (typically attempts to break the security or to flood the server). In such a case we refund the unused prepaid period proportionately, unless it was an intentional breach of these terms. We will write to you in advance about what we are doing and why, and give you an opportunity to respond — unless immediate harm to others is imminent; then we will write to you right afterwards. You can still export your data from your own device.
18. Dispute resolution
The relationship is governed by the law of the Czech Republic; this does not affect the rights that the law of your state of residence gives you as a consumer. Please write to us first at [email protected] — we will resolve most things right away.
If we do not agree, you can, as a consumer, start an out-of-court dispute resolution with the Czech Trade Inspection Authority: coi.gov.cz/informace-o-adr, Česká obchodní inspekce, Gorazdova 1969/24, 120 00 Praha 2. The procedure is free of charge for you. If you are a consumer from another EU state, the European Consumer Centre will advise you: evropskyspotrebitel.gov.cz. You can, of course, also turn to a court.
19. Changes to the terms
We inform you of a substantial change to the terms by e-mail at least 30 days in advance. If you do not agree with the change, you can end the account and we will refund a proportionate amount for the unused prepaid period. A change never affects a period you have already paid for.
Version 2026-10-31. Effective: 31 October 2026.
